Terms & Services

Effective Date: January 1, 2026

These Terms & Services ("Terms") govern your access to the website located at abileneautotrader.com (the "Site") operated by Abilene Home Improvements ("Company," "we," "us," or "our"), and they describe the framework under which we provide information about residential remodeling, repair, and upgrade services. By accessing or using the Site, submitting forms, or engaging our teams for home improvement work, you agree to these Terms. If you do not agree, please discontinue use of the Site.

1. Scope of Services

Abilene Home Improvements offers planning, coordination, and execution of home improvement projects including but not limited to kitchen and bathroom renovations, interior and exterior painting, roofing and exterior envelope repairs, flooring installation, window and door replacement, deck construction, and whole-home remodeling. Specific deliverables, materials, timelines, and pricing are defined only in signed written agreements or approved change orders—not by marketing content on the Site.

Photographs, renderings, and descriptive text on the Site are illustrative. Actual outcomes depend on property conditions, code requirements, product availability, and selections you approve during estimating.

2. Estimates, Contracts, and Change Orders

Online forms, email exchanges, and phone consultations may produce preliminary budget ranges. A binding contract is formed when you sign a project agreement that references scope documents, allowances, payment schedule, warranty terms, and schedule milestones. We reserve the right to revise estimates if concealed conditions, code amendments, or owner-directed changes affect labor or materials.

Change orders document adjustments to scope, cost, or duration. Work associated with a change order begins after written approval unless emergency safety repairs are required and permitted by law.

3. Client Responsibilities

You agree to provide accurate property information, reasonable access to work areas, utilities as needed, and timely decisions on selections. Delays caused by unavailable approvals, product backorders beyond our control, or restricted access may extend schedules and could affect pricing if crew mobilization must be rescheduled.

You are responsible for relocating personal belongings, valuables, and fragile items from work zones unless otherwise documented. We are not liable for damage to items left in active construction areas after you decline recommended relocation guidance.

4. Permits and Inspections

When permits are required, we identify them during planning and include associated fees in proposals unless noted as owner-responsible. You grant authorization for our representatives to apply for permits on your behalf where applicable. Inspections must pass before concealed work continues; failed inspections attributable to owner-directed deviations may incur additional costs.

5. Payment Terms

Payment schedules appear in signed agreements. Typical structures include deposits tied to material orders, progress draws at defined milestones, and final balances due upon substantial completion pending punch-list resolution. Late payments may pause work and accrue reasonable administrative fees as specified in your contract.

Returned payment instruments or failed electronic transfers may result in suspension of services until accounts are settled.

6. Warranties and Limitations

Labor warranties, manufacturer product warranties, and maintenance recommendations are provided in project closeout documents. Warranty coverage excludes damage from misuse, modifications by third parties, natural disasters, normal wear, or failure to maintain systems such as gutters, caulking, or ventilation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND GENERAL MARKETING MATERIALS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

Except where prohibited by applicable law, our aggregate liability arising from Site use or services performed under a signed agreement shall not exceed the amounts you paid for the specific project giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of use, even if advised of the possibility.

8. Site Use and Intellectual Property

Content on the Site—including text, graphics, logos, layouts, and photography—is owned by Abilene Home Improvements or used under license. You may view and print pages for personal, non-commercial reference. You may not scrape, mirror, republish, or exploit Site content for commercial purposes without written consent.

You may not attempt to interfere with Site security, inject malicious code, or use automated systems that impose unreasonable load on our infrastructure.

9. Communications and Marketing

By submitting contact or subscription forms, you consent to receive responses related to your inquiry. Promotional email requires your opt-in where applicable. You may unsubscribe using the link on our dedicated unsubscribe page. Message frequency varies. Standard data rates may apply for mobile notifications if offered in the future.

10. Third-Party Links and Tools

The Site may reference third-party resources such as manufacturer documentation or inspiration galleries. We do not control third-party sites and are not responsible for their content, privacy practices, or availability. Inclusion of a link does not imply endorsement.

11. Indemnification

You agree to indemnify and hold harmless Abilene Home Improvements, its officers, employees, and subcontractors from claims arising out of your misuse of the Site, violation of these Terms, or inaccurate information you provide, except to the extent caused by our gross negligence or willful misconduct in performing contracted work.

12. Dispute Resolution

Parties will attempt good-faith negotiation before pursuing formal remedies. If negotiation fails, disputes relating to these Terms or services shall be resolved in accordance with the dispute provisions set forth in your signed project agreement, or through binding arbitration or courts of competent jurisdiction as specified therein.

13. Force Majeure

We are not responsible for delays or failures resulting from events beyond reasonable control, including severe weather, supply chain disruptions, labor strikes, epidemics, utility outages, or governmental actions. Schedules will be adjusted and communication maintained regarding revised plans.

14. Modifications to Terms

We may update these Terms periodically. Revisions become effective when posted with a new effective date. Continued Site use after updates constitutes acceptance. Material changes to active project agreements require mutual written amendment.

15. Severability and Entire Agreement

If any provision is held unenforceable, remaining provisions remain in effect. For construction services, signed project documents together with these Terms (where incorporated by reference) constitute the entire agreement regarding the described work, superseding prior oral statements not documented in writing.

16. Contact

Questions about these Terms may be directed to hello@abileneautotrader.com. We respond to legal and compliance inquiries during standard business hours listed on the Site.
